The EB-5 Wave
On July 24, 2019, the U.S. Department of Homeland Security published a new rule that would increase the EB-5 investment amount. The one million non-TEA investment would become $1.8 million. And the $500,000 TEA investment would increase to $900,000. This new rule is set to take effect on November 21, 2019. Therefore, in order to secure the amount under the old rule, your EB-5 petition must be filed before November 21, 2019.
At Abdin Law, we saw a surge in EB-5 investors in the months of September, October, and November. Investors were aware of the upcoming change and many wanted to file their application and secure the old rate. In the month of November alone, we filed five EB-5 applications.
Moving forward, we expect to see a drop in the number of investors. For obvious reasons, the number of individuals with $900,000 to spare is much less than those with $500,000 to spend on the EB-5 program. However, we believe the program will still thrive at the new price point. It is interesting to note that while the EB-5 program has been around since 1990, this is the first price increase since inception.
